  • The mandatory nature of the data collection requires the user to agree to the collection of their data to allow Kujten to provide its services. On the website, in the data collection forms, the user is informed of the mandatory nature of the collection.

3. PURPOSES OF COLLECTION

3.1 - Collection is optional for all marketing and advertising operations implemented by Kujten, in particular newsletters, targeted promotional or commercial offers by email, telephone, on social networks or other media, for offers from its commercial partners, smartphone geolocation, competitions, the provision of sharing tools on social networks.

3.2 - Unless the user expressly refuses to receive prospecting messages, Kujten has a legitimate interest in collecting data without any consent for the following purposes:
  • For telephone or chat recordings of exchanges between customer service and the user for the purpose of improving the service and for the creation of evidence in the event of a dispute;
  • For user satisfaction management (product reviews);
  • To carry out statistical, analysis and segmentation operations with the aim of improving user knowledge;

4. THE DIFFERENT CATEGORIES OF PERSONAL DATA COLLECTED

Mandatory or optional, Kujten may collect the following data from the user:
  • Identification data (surname, first name, title, email address, date of birth and delivery address for products and services offered by Kujten);
  • Communications (by email or otherwise);
  • The IP address assigned to the user;
  • Location data or other communication data;

 

5. THE DIFFERENT COLLECTION METHODS USED

Data can be collected either through active user intervention or automatically.

The collection is done through active intervention by the user when they make a purchase, manage their order, order a delivery, subscribe to the newsletter, register their warranty, call for after-sales service and therefore transmit their identification data.

Other data, such as the date and time of access to the Site, the pages consulted or location data, are collected automatically, through the servers consulted and “cookies” placed on the site according to the procedure described below in article 9.

6. RECIPIENTS OF THE DATA

Personal data is intended for the BCS Group company and all of its subcontracting partners responsible for combating fraud and recovering unpaid debts, managing after-sales service, managing maintenance, hosting, development, and optimizing the site, managing marketing and promotional campaigns, as well as all administrative and judicial authorities that may be directly concerned or at their request.

All Kujten employees and subcontractors required to provide the services have access to the user's personal data only to carry out their duties. Each of them is subject to a strict obligation of confidentiality and security.

7. TRANSFER OF DATA OUTSIDE THE EU

Data may be transferred to a country outside the EU for the purposes described above to subcontractors or their subsequent subcontractors.

Kujten undertakes to make every effort to ensure the same confidentiality for data transmitted outside the EU by choosing subcontractors and, in turn, subsequent subcontractors who have opted for countries with protection deemed adequate or, failing that, by using standard contractual clauses in their contract.

8. DATA RETENTION PERIOD

With regard to mandatory collection, the data is kept for the time necessary to perform the services or for the time imposed by the various legal requirements, particularly in tax, commercial and criminal matters.

Regarding optional data collection, data is kept for three years from the last act of purchase or from the creation of the account in the absence of any purchase. This period is indicative and Kujten reserves the right to deviate from it in order to be able to respond to any questions or complaints addressed to it and in order to comply with all applicable laws, in particular tax and criminal matters.

9. COOKIES

9.1 - When consulting the Site, navigation cookies may be installed on the visitor's computer and record information relating to the visitor's computer's navigation on the Site, such as the pages consulted, the date and time of consultation, etc. An information banner is then displayed and allows the visitor to oppose this. BCS Group reserves the right to track the visitor's use of the Site using the website analysis service called Google Analytics provided by Google Inc. The Google Analytics system uses cookies (see paragraph above).

The data generated by the cookies concerning the use of the Site by the user (including the connection IP address) will be transmitted and stored by Google Inc. on servers located in the United States. This data will be used for the purpose of evaluating the use of the Site, compiling reports on the activity of the Site for the BCS Group Company and providing other services relating to the activity of the Site and the use of the Internet network.

Google Inc. may disclose this data to third parties if legally required to do so or when these third parties process this data on its behalf, including the publisher of this site. Google Inc. will not associate the visitor's IP address with any other data it may hold. Visitors may disable the use of cookies by selecting the appropriate settings on their browser. 10. SECURITY OF YOUR PERSONAL DATA

BCS Group undertakes to make every effort to ensure the confidentiality and security of user data or to ensure these obligations are met by the chosen subcontractors.

BCS Group ensures optimal security measures against loss, fraudulent intrusion, misuse, and alteration of the information entrusted to it. All data received on the website "www.kujten.com" is backed up daily and stored on a backup medium.

This data is kept for the time necessary to complete the transaction, namely for payment after dispatch of the goods, for reimbursement in the event of withdrawal or in the event of exercising the guarantee.

If the user chooses to accept the registration of their card so as not to have to re-enter their bank details for a subsequent purchase, these will be saved with OGONE. Their data will be deleted either automatically upon expiry of the card's validity date or at the user's request.

11. THE NATURE AND EXERCISE OF USER RIGHTS - APPOINTMENT OF A DPO
